Patents

O. Kayode & Co. advises on the full lifecycle of patent protection in Nigeria, from initial filing through prosecution before the Trademarks, Patents and Designs Registry to enforcement and commercialisation of granted rights.

Patent protection in Nigeria is governed by the Patents and Designs Act Cap P2 LFN 2004. Nigeria is a member of the Paris Convention, which allows applicants to claim priority from earlier filings in other jurisdictions within twelve months of the initial application date.

Nigeria is not a member of the Patent Cooperation Treaty (PCT). International patent applications made through the PCT do not automatically extend to Nigeria; a separate national application is required for Nigerian protection.

We advise clients on patentability assessments, the preparation and filing of patent applications, prosecution before the Registry, freedom-to-operate analysis, patent licensing and assignment, and enforcement of granted patents through the Federal High Court, which has exclusive jurisdiction over patent matters.

Relevant legislation: Patents and Designs Act Cap P2 LFN 2004. Legal advice is tailored to the specific facts of each matter.
